Freedom of Information Act

We Have the Receipts

On February 24, 2026, Keep Amity Human filed a Freedom of Information request with Amity Regional School District No. 5. The district produced purchase orders, invoices, and credit card statements. Here is what they show.

Total AI Spending Found: $19,216.51

⚠ The District Said $11,000. The Records Say $19,216.51.

On February 24, 2026, the district sent Student Happenings #26 responding to student concerns. Here is what they claimed versus what the FOIA records show.

What the District Said

"Amity is not increasing its spending on AI platforms this year. Amity purchased Magic School AI in the 2025-26 school year for $11,000."

What the FOIA Shows

The district spent $19,216.51 across five AI products. They named one. The records document four more, including two direct OpenAI/ChatGPT contracts totaling $7,416.53.

What the District Said

"There is no evidence or credible claims connecting MagicSchool AI to U.S. Immigration and Customs Enforcement."

What the FOIA Shows

The district holds two active, paid, direct contracts with OpenAI, the company with a documented ICE contract. Invoice numbers and check amounts are below.

What the District Said

"We are working on obtaining an original copy of the AI policy for teachers, as well as a full listing of the AI tools that the district pays for."

What This Means

The district cited a policy it does not yet have in hand as evidence students have nothing to worry about. They also admitted they cannot produce a complete list of AI tools they are funding.

In AI spending not mentioned in the district's newsletter

The district's response to student concerns named one product and one dollar amount. The FOIA records document four additional AI tools purchased this school year, spread across two departments and three vendors. Whether the omission was intentional or reflects a genuine lack of internal awareness (the administration's own email admits they are still working on obtaining a complete list of AI tools the district funds) the effect is the same: students were given an incomplete picture.

The invoice was marked overdue before payment was processed in late August, meaning the contract was already active before it was fully paid. The subscription automatically extends into the next school year.

This is a direct contract with OpenAI, not a third-party tool built on OpenAI's platform. The district pays OpenAI directly. Invoice #YTMZUVSM-0002 is that evidence.

The district did not inherit this contract, they actively chose to expand it three months into the school year. This was a deliberate decision to increase the district's direct relationship with OpenAI, made without any student notification or public discussion.

Snorkl is an AI tool that listens to and evaluates student speech and written explanations. Students demonstrate understanding verbally; the AI provides feedback and assessment. This was purchased in November 2025 with no public announcement and no student notification.
Diffit Not Mentioned by District
Diffit Inc. Β· 1932 Blake Street, Berkeley, CA 94704
$299.98
PO Number:00301141-003
PO Date:November 5, 2025

Teachers:Katie Beezer & Nicole Raiola
Term:Jan 6, 2026 – Jan 6, 2027
Payment:US Bank credit card (Dec and Jan statements)
Department:Staff Development (not Technology)
Diffit is an AI tool that generates differentiated reading materials and lesson content. Notably, this purchase was routed through Staff Development rather than Technology, making it invisible in any single-department budget review. Whether intentional or not, purchasing AI tools through multiple department budgets makes the true total harder to see at a glance.

πŸ”— The OpenAI–ICE Chain, Documented

1
OpenAI holds an active contract with U.S. Immigration and Customs Enforcement (ICE). This is documented public record, reported by multiple national news outlets.
2

3
In October 2025, the district expanded that same OpenAI contract by six additional seats for $1,354.58. This was a deliberate expansion, not a legacy renewal.
4

5
The district's February 24, 2026 newsletter stated there are "no evidence or credible claims" connecting district AI spending to ICE. The FOIA records above are the evidence. The invoices are the claims.
